Affordability Exemption in Texas

Basic facts:

Taxpayer age is 59, single with no dependents
Taxpayer lives in Texas
AGI is $16,000
FPL is $11,770
138% of FPL is $16,242.60

Does this person qualify for an affordability exemption since her AGI is less than 138% of the FPL?

I keep reading over this section of the ACA exemptions and I keep thinking that the answer is yes she qualifies for the exemption.  BUT, I just can't convince myself that I am right.

I really would appreciate some help.  Thanks -

    Well I am not surprised that Texas is the state to do it, but I have to say that I am a little jealous. In my particular situation, it would probably just end up saving a big hassle, so I would apply for it.  That is not to say that I am against the ACA, though, and I consider my position pretty much right in the middle, where I am just not certain yet as to all the implications that it has, and I recognize that it will take time to sort it all out and evaluate it.  Interesting stuff, and thanks for sharing.
